To be eligible for FMLA, an employee needs to have worked for at least one year and 1,250 hours in a rolling calendar year immediately preceding the request. FMLA leave allows eligible employees to take up to 12 weeks off for the following:
- Birth or adoption of a child
- Placement of a child for foster care
- Own serious health condition
- Care for a family member with a serious health condition
- Impending deployment of a family member in the armed forces
Leave can be taken in one large chunk of time, like recovering from a surgery, or taken intermittently for recurring conditions like migraines, or for recurring appointments, like physical therapy.
If an employee knows in advance that they will need FMLA leave, 30 days’ written notice is required whenever possible. Otherwise, an employee must provide written notice as soon as practical.
Once HR is notified, the employee will be given a form that the employee’s provider must complete, or if it is for a family member, the family member’s provider must complete. The form then needs to be returned to HR.
Employees will be required to use any time off they have while on FMLA. This might include Paid Family Medical Leave (PFML), if eligible. Other leaves include sick time, personal time, vacation time, or summer days. Short Term Disability might apply as well after a two week waiting period.
